1. About these terms
These terms govern use of 360-Audit.com and purchases of our 360 Audits for clients, 360 Masterclass Bundles, PDFs, checklists, templates, other digital products and related services. “You” means the person or business using or buying them. If purchasing for a business, you must have authority to bind it.
We provide these terms before purchase. An order becomes binding when we send confirmation accepting it. If we cannot accept an order, we will tell you and return any payment taken for it. Product descriptions, the agreed order and any expressly agreed written service proposal form part of the contract. Specific agreed scope takes priority for the relevant service, subject always to mandatory law.
Our Acceptable Use Policy applies to use of our services. Our Privacy Policy, Cookie Policy, Accessibility Statement, AI Use Policy and Copyright Policy explain the relevant practices. Reading a privacy or cookie policy does not itself give consent to data processing or optional tracking.
2. Eligibility and accounts
Purchases and accounts are intended for people aged 18 or over. Provide accurate details, keep them current and protect your login credentials. Notify [email protected] if you suspect unauthorised access. An individual purchase permits one learner unless a team or multi-user licence is expressly included.
You are not automatically treated as a business customer simply because you study professional skills. Your legal status as a consumer depends on the circumstances and applicable law.
3. What you purchase
The product page and checkout specify the included chapters, resources, access period, delivery method, support and any completion requirements. Do not assume that every bundle includes every lesson, future product, live session, personal consultation or update.
For bespoke audits, the written proposal should specify the websites or apps, scope, deliverables, exclusions, fees, timing and your responsibilities. Additional work requires agreement. An audit is an assessment of the agreed sample and scope, not a guarantee that every possible issue has been identified.
Descriptions of examples, results or potential audit fees are illustrative unless expressly stated otherwise. We do not guarantee income, employment, clients, rankings, conversion improvements or a particular commercial result. This does not excuse misleading statements or remove obligations arising from a specific promise we make.
4. Delivery, access and technical requirements
We use Kajabi for hosting and course delivery. Unless the order states a later date, digital access is normally made available after accepted payment and account setup. Contact us if access is not received.
You need a suitable device, internet connection and compatible browser. Any special requirements or additional software costs must be disclosed before purchase. Third-party software, free plans and features can change; we do not control their future availability. You need not buy an undisclosed paid upgrade to receive what we have contracted to supply.
The access period is the one stated at purchase. Any use of “lifetime access” must be expressly defined in that offer; these terms do not silently shorten an access promise. We will make the access period clear before you commit. Contact us before purchasing if you need clarification; a missing statement does not give us an unrestricted right to end paid access.
We may make reasonable updates, correct errors and maintain systems. We will not materially reduce paid-for content, access or functionality during the agreed period without an appropriate contractual and legal remedy. If we permanently discontinue a service before the promised period ends, we will provide an appropriate alternative or refund where required.
5. Prices and payments
The price, currency, applicable taxes, total amount payable and payment schedule are shown before you commit. Consumer prices include applicable VAT and unavoidable charges. Clearly identified business-only quotations may show VAT separately.
We use Kajabi Payments and may offer Klarna, Clearpay and Link by Stripe. Payment-provider terms apply to their services but do not replace our obligations as seller. Eligibility, credit decisions and repayment arrangements offered by an independent provider are its responsibility.
A fixed instalment plan spreads an agreed total purchase price over a stated number of payments. It is not a rolling subscription. Unless a cancellation right, refund entitlement or written agreement applies, stopping use or deleting an account does not cancel the remaining agreed payments. A plan ends after the agreed instalments and does not automatically continue.
A recurring subscription is offered only if described as such before purchase, including its price, billing frequency, renewal, minimum term if any and cancellation method. You can request cancellation by emailing [email protected]. Cancellation normally stops future renewal after the current paid period unless the offer or applicable law gives you an earlier right.
If payment fails, we will normally notify you and give a reasonable opportunity to resolve it before suspending access. We will not impose undisclosed penalties or accelerate future payments merely at our discretion. Contact us promptly if you are experiencing payment difficulties. Where a third-party instalment provider is involved, we will communicate authorised refunds through the relevant payment process; do not assume a refund automatically cancels its separate agreement until confirmed.
6. Consumer cancellation rights
If you are a UK consumer buying online, you normally have 14 days after the contract is made to cancel a digital-content or service contract, subject to applicable exceptions and the rules below. Other mandatory local rights may apply. If legally required cancellation information is missing, the period may be extended by law.
Digital content supplied immediately
We may supply streamed or downloadable digital content during the cancellation period only after obtaining your prior express consent and acknowledgement that beginning supply will cause you to lose the cancellation right for that digital content. We will provide the required contract confirmation, including that consent and acknowledgement, in a durable form such as email.
Accepting these terms alone is not the separate express consent and acknowledgement required for early supply. If the requirements are not met, we will not treat your cancellation right as lost simply because you accessed the content. This loss of a change-of-mind right does not affect remedies for faulty or misdescribed content.
Services started early
For services such as a bespoke audit, if you expressly request work to begin during the cancellation period and then cancel, you may have to pay a proportionate amount for work supplied up to cancellation where the legal conditions are met. The right is lost on full performance only where the required prior request, consent and acknowledgement have been obtained. Mixed purchases may have different rules for their service and digital-content elements.
How to cancel
Email [email protected] or write to our registered office with a clear statement that you wish to cancel. You may use the form below, but do not have to. We will make any cancellation refund due within the statutory timeframe, normally within 14 days after being informed, using the original payment method unless you agree otherwise, without a refund fee.

7. Refunds and problems
Any additional voluntary refund guarantee must be expressly stated in the offer. A refund policy offered by our hosting provider to its own subscribers does not automatically apply to purchases from us. Outside statutory rights and an expressly advertised guarantee, we consider discretionary requests individually.
Digital content supplied to consumers must be of satisfactory quality, fit for a purpose made known and agreed where the law requires, and as described. Services must be performed with reasonable care and skill. Depending on the circumstances, statutory remedies can include repair, replacement, repeat performance, a price reduction or a refund. Contact [email protected] to report a problem. These terms do not impose a blanket “no refunds” rule or exclude mandatory remedies.
8. Ownership and licence to learning materials
Our original website design, copy, graphics, videos, audio, learning materials, PDFs, checklists, templates and branding belong to us or our licensors to the extent protected by applicable intellectual property law. No ownership transfers merely by visiting the website or buying access. We do not claim exclusive rights in general ideas, unprotected methods, public-domain material or rights belonging to others.
Unless a product-specific licence expressly gives wider rights, we grant the purchaser a non-exclusive, non-transferable licence to access the purchased materials during the agreed access period and retain downloads expressly supplied for ongoing use, subject to these terms.
You may apply the knowledge and methods you learn in your own business and paid client work. Editable templates supplied for that purpose may be adapted for your own or your clients’ audit deliverables. You may share the resulting client deliverable with that client, but not redistribute the reusable source template or course library unless a wider licence expressly permits it.
You must not share account access, resell the course, publish recordings or distribute protected materials as a standalone resource, competing course or template collection. Do not upload restricted materials to shared AI systems or use them for model training without written permission, except where mandatory law permits the activity. Statutory copyright exceptions and third-party licences remain unaffected.
Third-party examples, brands and tools remain subject to their owners’ rights. References do not imply endorsement. For bespoke deliverables, ownership and licences are set out in the agreed proposal; payment does not automatically transfer all underlying methods, tools or pre-existing materials.
9. Your submissions and confidentiality
You retain ownership of original work you submit. You grant us only the non-exclusive rights reasonably needed to host, display to the intended audience, review and respond to it, and to supply the service through necessary providers. This is not permission to use private submissions in marketing, publish testimonials, or train AI models. Those uses require a separate appropriate agreement or permission.
Do not submit personal or confidential client information without authority and agreed safeguards. Where a project involves confidential business information, each party will use it only for the agreed project, disclose it only to authorised people who need it and are bound by confidentiality, and protect it with reasonable care. These obligations do not cover information lawfully public, already lawfully known, independently developed or lawfully obtained elsewhere. Legally required disclosure remains permitted.
Where we process personal data on a client’s behalf, an appropriate data-processing agreement must be agreed before that processing starts.
## 10. Acceptable use and enforcement
Follow our Acceptable Use Policy. We may remove prohibited content or proportionately suspend or terminate access for material breaches, non-payment or security and legal reasons. Where practicable we will give reasons and a reasonable opportunity to remedy a breach. Urgent action may be needed for serious abuse, fraud, infringement or threats to security.
You may challenge a decision at [email protected]. Consequences must be proportionate and consistent with applicable law. If we terminate without your breach before fulfilling the contract, we will provide any refund or other remedy required for the unprovided portion. Termination does not remove accrued rights or automatically forfeit all payments.
11. AI and professional judgement
We use AI-assisted creative and editorial tools as described in our AI Use Policy. We remain responsible for what we supply. Educational material and audits support informed decisions but do not replace legal, tax, regulated financial or specialist security advice. An accessibility audit does not by itself certify legal compliance. Course completion certificates recognise the stated completion requirements and are not regulated qualifications unless expressly identified as such.
12. Our responsibility
Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability or statutory right that cannot lawfully be excluded or limited.
For consumers, we are responsible for foreseeable loss or damage caused by our breach or failure to use reasonable care and skill. Loss is foreseeable if it is obvious or both parties knew it might happen when the contract was made. We do not exclude mandatory digital-content or service remedies. Consumer purchases are not subject to the business cap below.
For business customers only, and subject to the non-excludable liabilities above and any separately agreed service contract, our total liability arising from a purchase is limited to the total price paid or payable for that purchase. To the extent lawful and reasonable, we exclude indirect or consequential losses and loss of profit, revenue, business opportunity or anticipated savings. These restrictions apply only where enforceable under applicable law and are not a guarantee that every limitation will apply in every case.
13. Changes and events outside our control
We may update terms for future purchases. Existing purchases remain governed by the terms agreed at purchase unless a lawful variation is expressly agreed or a limited change is necessary for legal or security reasons. We will give appropriate notice and preserve applicable cancellation and refund rights. We will not retrospectively increase an agreed fixed purchase price.
If events outside our reasonable control delay delivery, we will tell you and take reasonable steps to reduce the effect. This does not remove rights to end a contract or obtain a remedy where the law provides them.
14. Complaints and governing law
Contact [email protected] with your order details and concern. We will investigate and explain our response. You do not have to complete an internal complaints process before exercising a legal right.
These terms are governed by the law of England and Wales. Business disputes are subject to the exclusive jurisdiction of its courts. Consumers retain mandatory protections of the law where they habitually live and the right to use any court available under applicable consumer law, including their home courts where permitted. We do not impose mandatory US arbitration or a class-action waiver.
If a provision is unenforceable, the remaining terms continue where lawful. Failure to enforce a right immediately does not waive it. Neither party may transfer a contract in a way that unlawfully reduces the other’s rights; any permitted transfer by us will preserve your contractual protections. These terms do not exclude reliance on statements or promises where the law protects that reliance.
15. Public website, links and availability
You may browse our public pages and use materials expressly made available for that purpose. You may link to publicly available pages in a fair and lawful way, including individual product or article pages, provided you do not suggest an endorsement, disguise the source, bypass access controls or present our website within a misleading frame. Ordinary links, legitimate criticism and lawful quotation are not prohibited.
Permission to download a file is permission to use it under its stated licence, not permission to republish it. You may download and keep resources expressly provided for download; adapt editable resources where section 8 or their specific licence permits; and use reasonable copies for your own learning or authorised business work. Preserve applicable copyright and attribution notices, except where an expressly editable or white-label resource permits removal or replacement. Videos offered only for streaming may not be recorded or systematically downloaded without permission or an applicable legal right.
Our public pages may contain general educational information and links to external websites. Content can become outdated, and a linked provider controls its own services. We do not promise that public pages or third-party links will always be available, accurate or uninterrupted. We will take reasonable care over information we publish. These statements do not reduce our responsibility for paid products, contracted services, misleading statements or rights described elsewhere in these terms.
We may temporarily interrupt access for maintenance, error correction or urgent security work. Where practicable, we will give notice of significant planned disruption and take reasonable steps to minimise it. We remain responsible for delivering what you purchased, including where we use hosting providers or subcontractors. External-provider involvement does not automatically exempt us from liability.
16. Security, automation and misuse
In addition to our Acceptable Use Policy, you must not:
- Obtain restricted materials by bypassing payment, authentication, download limits or other access controls.
- Use bots, scrapers or equivalent manual processes to systematically extract protected course content or other users’ information without permission, except where mandatory law permits it.
- Attempt password guessing, unauthorised access, vulnerability scanning or security testing without written authorisation from the relevant system owner.
- Trace, collect or expose another person’s private account information or credentials without lawful authority.
- Overload or interfere with our website, course delivery, checkout, hosting infrastructure or another person’s use of the services.
- Disguise the source of a fraudulent message, impersonate another person or misrepresent authority to act for a business.
Normal browsing, assistive technologies, authorised integrations and ordinary search-engine indexing of public pages are not prohibited by these restrictions. If you discover a suspected vulnerability, report it privately to [email protected] without accessing additional information or testing beyond your authority. A report is not permission to test.
Keep appropriate security measures on your own device. We do not guarantee that every download or external website is free from malicious code, but this does not exclude our own duties of reasonable care or applicable remedies if content we supply damages your device or other digital content.
17. Additional provisions for client audits
Scope, cooperation and changes
Our audit work is limited to the scope and deliverables agreed in the proposal or order. Unless expressly included, it does not include implementation, development, penetration testing, continuous monitoring, a complete legal-compliance review or testing every possible page, device, browser or assistive-technology combination.
Provide accurate information, relevant access and timely decisions reasonably needed for the agreed work. Ensure you are authorised to grant access and share materials. We will request only access appropriate to the project. Use secure, limited-access credentials where possible rather than sending personal passwords by ordinary email.
If missing information, access or approvals affects delivery, we will explain the effect and agree a revised timetable where necessary. Extra scope, fees or expenses require agreement before we incur them; we do not gain an automatic right to charge unspecified extras.
Findings and implementation
An audit reflects the agreed sample, available information and conditions at the time of assessment. Changes to a website, app, content, tracking, platform or legal requirements can affect its findings. Recommendations involve professional judgement and may require validation or further specialist work. Unless the proposal includes implementation or retesting, the client arranges those activities. We remain responsible for performing our agreed work with reasonable care and skill.
Use of reports
Unless the proposal grants different rights, on payment of the agreed fees you receive a non-exclusive, ongoing licence to use the final audit deliverables for your business and share them with your staff, professional advisers and implementation suppliers for that purpose. They must respect confidentiality and may not resell the report, extract our reusable resources for redistribution, or represent it as their own independent assessment.
You may share the report with another person where law or a competent authority requires it. Any other public publication, resale or extension of reliance to an unrelated third party requires agreement, unless a legal right overrides this restriction. Nothing prevents you from discussing your experience, making a genuine complaint or obtaining legal advice. Our pre-existing methods and reusable tools remain subject to section 8, while your own materials remain yours.
No unrelated third party obtains a contractual right to rely on an audit merely because it receives a copy, unless we expressly agree otherwise or applicable law provides a right. We will not use private client reports, logos, results or confidential project details in marketing without appropriate permission.
18. Suggestions and feedback
You may send suggestions about our website, courses or services. We may use general suggestions to improve them without paying a fee unless agreed otherwise. You retain any intellectual property you own; you give us a non-exclusive permission to use the suggestion only to the extent reasonably needed for that improvement.
This does not make confidential audit information, private submissions or personal information public, and does not grant a right to publish your name, testimonial or identifiable work for marketing. Section 9 and our Privacy Policy continue to apply. Tell us before submitting an idea if you want a separate confidentiality or licensing agreement.
19. Investigations, lawful remedies and general provisions
We may preserve relevant records and investigate suspected misuse where reasonably necessary. Any use or disclosure of personal information must have an appropriate lawful basis, be proportionate and follow our Privacy Policy and applicable law. These terms do not give us an unrestricted right to disclose your identity or communications.
Where a material breach causes loss or threatens our intellectual property or security, either party may seek remedies available under applicable law, including a court order where justified. A breach is not automatically deemed unlawful or irreparably harmful, and you do not waive the right to challenge a claim. Legal costs are recoverable only where applicable law, a court order or a separately enforceable agreement permits; they are not automatically payable merely because we bring a claim.
The agreed order, any agreed service proposal and these terms, together with documents expressly incorporated before agreement, describe the relevant contract. They do not exclude legally protected pre-contract statements, misrepresentation claims or mandatory consumer rights. No unrelated third party has a right to enforce this contract under the Contracts (Rights of Third Parties) Act 1999 unless expressly stated, without affecting rights available independently under law.
If a provision cannot lawfully be enforced, it will be treated as ineffective to the necessary extent. It will not be rewritten to impose a new unfair obligation; the remainder continues where it can lawfully operate. Section 14 governs complaints and jurisdiction, and section 13 governs changes to existing contracts.
